It is highly recommended to carefully read and understand all the information in the Terms and Conditions that our company, Eternal Himalaya Adventure Pvt. Ltd. operates under. Upon agreement to the following Terms and Conditions, the client is liable to act under the legally binding arrangement of our company’s contract that clarifies various criteria like ideas, information, permissions, and deals established between the client and our company. 

Issues and procedures taken by the client and our company, including Booking Confirmation, Payment, Refund, Trip Cancellation, and other charges levied as per our company’s Privacy Policy are covered by the agreement.  

The Contract

Eternal Himalaya Adventure Pvt. Ltd. is a dependable and trustworthy firm that operates under a fully licensed registration below legal terms that are put forth by various departments of the Government of Nepal (Registration Number 221987/76/77). Along with that, our company is also legally registered with and under numerous other national and international agencies. 

Mr Basu Dev Nepal is the chief of our company. He has been working in the field of travel and tourism for over 25 years. Our company is located at Nayabazar and the primary aim of Eternal Himalaya Adventure Pvt. Ltd. is to offer quality services to our valued customers from all over the world and showcase to people of different countries the wonderful attributes of Nepal.  

Terms and Conditions of Use

Passport and Visa

A valid passport is required to be carried along by the traveller, along with the visa of the country he/she is travelling to. It is also advised to have passport validity of up to 6 months beyond the total duration of the trip. Our company will not be held liable if travellers are returned back or not allowed to enter the country on their trip due to the passport criteria not being met. As such, travellers are encouraged to have everything regarding all the necessary documents in place before making the trip.     

Travel Insurance

It is mandatory to have a proper Travel Insurance Policy before booking any trip with Eternal Himalaya Adventure Pvt. Ltd. The insurance policy must include medical coverage, air ambulance service, and helicopter rescue services. It is also strongly recommended to get cancellation insurance as this allows the elimination of any hassle that may arise due to unforeseen circumstances during the journey. It is strongly recommended to all clients to ensure that their insurance policies provide all the necessary protection and covers most of the travelling activities that will be taken up during the journey.  

A copy of your insurance paper will also be required by us as proof before the trip. If you are unable to provide us with the insurance certificate for any reason, then a suitable policy/agreement will have to be agreed upon on the spot. However, if you are unable to do that due to circumstantial issues, then you will be forbidden to continue on the trip. Also, you will not be entitled to any refunds for the services not provided due to this reason. 

Facilities and Flexibility

Different types of trips are provided by Eternal Himalaya Adventure Pvt. Ltd., involving various activities different from the standard holidays that travellers are accustomed to. These trips, in retrospect, also involve certain levels of difficulty that pose risks of illness and unpredictable circumstances that may bring forth harm in any form. They are also prone to accidents. As such, remote areas that are part of the destinations during the travel journey might lack advanced medical facilities. Thus, receiving immediate help can be challenging in such circumstances. Likewise, unpredictability can also ensue in terms of political instability or natural calamities that could occur en route the travel journey. Our company will not be responsible for such accidents. Therefore, our clients will have to agree to comply with all potential risks associated with the journey.     

Moreover, clients should also be open to any changes in the plan in case of unavoidable circumstances and should be flexible enough to adapt to impromptu plans, reroutes, changes in accommodations, and modes of transport. Additionally, if amendments and alterations in the itinerary are required to be made during the trip due to circumstances that are unavoidable and uncontrollable by our company, all the extra charges resulting from the alterations will have to be bolstered by the client.  

As a guide/leader is provided to the clients by Eternal Himalaya Adventure Pvt. Ltd., clients are expected to follow the guidance and expertise of the guide/leader. They are required to cooperate with the guide/leader at all times as the main objective of the guide/leader is to ensure that clients are getting the best possible services. Understandably, travelling with a group can be difficult, especially when taking into consideration the varied interests of people in the group and everyone's different physical abilities. For that, adjustments will have to be made to maintain a functioning harmony. Our company holds every right to abstain from or accept any person to be a member of the group at any time during the trip. Accordingly, we also hold the right to refuse aid or refund any travellers who are prohibited from continuing a trip due to the action of the client himself which violates the law/s of the country of travel.  

It is suggested to refer to the Trip Inclusion page, along with the details for each trip before booking a trip with us at the head office of Eternal Himalaya Adventure Pvt. Ltd., Kathmandu. A specified hotel will be the meeting point before the commencement of the trip unless you otherwise specified.  

Booking

Various procedures will have to be gone through to book a trip with Eternal Himalaya Adventure Pvt. Ltd. Please note that the term “Trip” on the website is used as an umbrella term that refers to all the itineraries designed for various packages including trekking, tours, sightseeing, hikes, expeditions and similar others.  

You will have to fill up the Booking Application Form to book a trip with Eternal Himalaya Adventure Pvt. Ltd. Furthermore, 20% of the total trip cost must be paid before the trip for booking confirmation. The 20% deposit is non-refundable.

However, for trips to Tibet and Bhutan, you will have to pay 50% of the total cost in advance. You will have to pay the rest of the 80% (50% for trips to Bhutan and Tibet) balance due on arrival in Kathmandu before the commencement of the trip. You will be provided with the remaining documents after the completion of all procedures and after our company receives the total cost for the trip. 

Payment Options and Method

Two feasible and safe options for payment are available, i.e. Bank Transfer and Credit Cards (Master/Visa/American Express/Union Pay/JCB/SCT Card). The mode of payment must be clearly- mentioned by the client and all the required details must be provided about the Credit Card while filling the Booking Application Form. However, the balance due (80% for Nepal trips and 50%for Tibet and Bhutan trips) must be paid in cash before the commencement of the trip from Kathmandu. Likewise, all payments via Credit Card are subjected to a 4% surcharge. Surcharges are applied to all payments, including deposits, final balances, trip extensions, and miscellaneous purchases. This charge is levied by the credit card payment service provider and not by our company. For the benefit of the customer, these charges provide consumer protection for the services purchased, following the terms and conditions of the in-use credit card.

Note: The clients will be charged an additional cost of USD 100 to USD 200 for cases of trip extension up to 10 days and more respectively. However, this additional charge is only for a single supplement. An additional USD 250 will be charged for climbing/expedition trips.  

Cancellation

The responsibility is not beholden by our company for voluntary withdrawal or cancellation of trips by the customer. Hence, the amount paid to the company will not be refunded after the beginning of the trip. If any services such as accommodation, sightseeing, meals, transportation, etc. included in the itinerary/trip are not used by the customer during the trip itself, then no refunds or reuse will be provided in accordance with the unused remaining portion during the trip. Our company can use discretion in the setting of conditions for refunds. Therefore, a few conditions mentioned are subject to change according to our company's procedure. We hold every right to cancel trips booked by the customers before it is guaranteed to run or before the signing of an official agreement. Once the trip has two fully paid travellers, it is guaranteed to run, unless the minimum number states otherwise. 

Cancellation of the trip can be due to various reasons, like unfortunate circumstances resulting from unforeseen natural disasters, cancelled flights, strikes, industrial action, wars, riots, quarantine, government intervention, weather, or deteriorating health condition of a group member. The customer, in such cases, can either ask to get back the 80% of the total trip cost paid to the company (13% Government Tax will be deducted) or an alternative trip with the same price can be booked and underwent, immediately in the following season of the same year. However, the booking deposit, i.e. 20% of the total amount, will remain non-refundable. 

A written notice will be required in case of any cancellation. It should be ensured that the date of the trip cancellation is the date on which our company receives the written cancellation. 100% of the total cost is reusable for a year if you cancel the trip a month before the departure date of the actual trip. Likewise, 100%, 80%, and 50% of the total charged amount can be used if the company gets a cancellation notice a month, 15 days, and 7 days before the departure date of the actual expedition respectively.  

Trip Amendment

It is important to note that all the amendment conditions apply to the trips listed on this site only. Important information about the amendment fees in case of any changes during, while, or after the booking is given henceforth-

A total of USD 50/person is charged to the customer if we receive a request for the booking amendments at least 60 days before the trip. However, if the customer’s request is less than 60 days before the trip departure booking amendments, then the charges will be placed as per the cancellation policy mentioned above. 

New cost will be applied to the existing trip if it is subjected to cases of any changes in the price during the procedure of booking and the amendments. These changes might not be applied by the company ourselves but can be levied upon the company by third parties, i.e., the hotels or the service providers working with our company. 

An additional administration fee of USD 20/booking per change will be levied upon any changes, amendments, or additions in aggregation to the trips you have booked- for example, hotels, transfers, additional days, etc. These additional charges are imposed by hotels, ground operators, or airlines and not by the company ourselves. 

The amendments will not be made within 10 days of the original departure of the trip. However, if changes are made (although rare), then a minimum of USD 50 or over will be charged. 

Health Conditions

A well-documented medical certificate from a valid medical institute by the client will be required before commencing the trip. The well-being and health of our customers are our top priority. To execute our care for our customers, we must be informed about any type of medical issues or conditions by our clients at the time of trip booking itself. The company will not be responsible for any type of mishaps and we are not liable to bear medical and evacuation expenses on behalf of participants. Therefore, our clients are requested to consult their doctors for a thorough checkup and have proper vaccinations done before booking a trip with us. If necessary, clients can also request the Company for additional services during the trip or the stay in the country of travel. 

Weather and other unfavourable conditions

The unpredictability of the weather, especially in the mountains, is something that should be taken into account by all customers. The uncertain weather conditions, especially in the Everest, Jomsom, and Kanchenjunga regions of Nepal, can sometimes lead to unfavourable circumstances where trip delays or flight cancellations can occur. We will cover the expenses of accommodation and food in the departing location until proper flight arrangement is done. 

However, our company holds every right to practice alternative reroutes to the original trip or transport in favour of the situation without any additional cost. Please note that our company will not be held responsible for any international flights missed, losses caused by Altitude Sickness, or any other unpredictable circumstances. The participants will have to pay for all the charges incurred. Nevertheless, we will connect and assist you in making necessary alternative arrangements. But additional charges will have to be covered by the customers themselves. 

Despite the statement of all conditions and presenting information about trips on the website and brochures of our Company, we will not be held responsible for unforeseeable situations that may arise before or during the trips. We will, however, try our best to give prior notice about situations and take alternate strategies to deal with them to make sure that our customers are getting the best available deal in a given situation. These aforementioned booking conditions may only be practised in special circumstances and executed in writing via a letter from the Chief of the Company. All the legal agreements set up and signed between the client and the Company are subjected to and governed by Nepalese law. 

Note: Our Terms and Conditions, as mentioned, are prepared in accordance with the laws of the Government of Nepal and function under their jurisdiction. Therefore, intervention and holding the authority to make any amendments can only be done by the head of the Company.
